TERMS OF SERVICE
PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, OBLIGATIONS, AND REMEDIES.
1. OVERVIEW
This Terms of Service Agreement ("Agreement") is entered into by and between HomePe Technologies Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 4/147-12, K.N.R Building, Muthiahpuram, Thoothukkudi, Tuticorin- 628005, Tamil Nadu, India (hereinafter referred to as "Company," "we," "our," or "us"), and you ("you," "your," "User," or "Customer").
This Agreement governs your use of the HomePe mobile application, website, APIs, and all related services (collectively, the "Platform").
By accessing, browsing, downloading, or using the Platform in any manner, you acknowledge that you:
- Have read, understood, and agreed to be bound by this Agreement;
- Consent to our Privacy Policy (which forms an integral part of this Agreement); and
- Agree to comply with all applicable laws and regulations.
We reserve the right, in our sole discretion, to modify or replace this Agreement at any time. Changes will be effective upon posting to the Platform. Your continued use after modifications constitutes acceptance of the revised Agreement. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ACCESS OR USE THE PLATFORM.
2. ELIGIBILITY
• You must be at least 18 years of age and legally competent to enter into binding contracts under Indian law.
• You must not be barred under any applicable laws, including RBI regulations, from accessing financial technology platforms.
• If you represent a company or legal entity, you confirm that you have full authority to bind that entity to these Terms.
• Use of the Platform is restricted in jurisdictions where it is prohibited by law.
3. SERVICES PROVIDED
The HomePe Platform provides tools and features to:
• Manage loans, EMIs, repayment schedules, and financial plans.
• Generate personalized loan repayment simulations and suggestions.
• Track savings, prepayment plans, and payment history.
• Access financial insights, reminders, and budget planning.
• Integrate with banks, NBFCs, or third-party financial service providers (subject to separate agreements).
⚠️ Important:
• HomePe does not provide loans or credit itself. We act as a technology enabler to help you manage financial data.
• Any financial decision you make using HomePe is solely your responsibility.
• HomePe is not liable for decisions taken based on suggestions or simulations generated by the Platform.
4. USER RESPONSIBILITIES
You agree that you will:
• Provide accurate, complete, and updated information during registration and use.
• Use the Platform only for lawful and intended purposes.
• Maintain confidentiality of your account login details.
• Be responsible for all activity under your account.
You agree that you will NOT:
• Engage in unlawful, fraudulent, or harmful activities.
• Misuse the Platform to spread viruses, malware, or spam.
• Infringe intellectual property or violate privacy rights of others.
• Circumvent or attempt to bypass security features of the Platform.
• Use automated tools (bots, crawlers) without authorization.
Violation of these obligations may result in immediate suspension or termination of your account.
5. INTELLECTUAL PROPERTY
• All intellectual property, including but not limited to text, graphics, software, trademarks, logos, APIs, databases, and algorithms available on the Platform, belong to HomePe Technologies Private Limited.
• You are granted a limited, non-exclusive, revocable license to use the Platform for personal use.
• You are not permitted to copy, distribute, modify, reverse engineer, or exploit any part of the Platform without our prior written consent.
6. USER CONTENT
Some features may allow you to upload or input data, such as loan details, documents, or comments (“User Content”).
By submitting User Content, you represent that:
• You own or have necessary rights to share such content.
• The content does not violate laws, third-party rights, or public policy.
You grant HomePe a worldwide, royalty-free, sublicensable license to use, store, display, and process your User Content for providing Services.
We reserve the right to remove content that is illegal, harmful, or violates this Agreement.
7. COMPANY’S USE OF USER DATA & CONTENT
• You acknowledge and agree that financial data you provide (loan details, repayment info, documents, etc.) may be processed to deliver core functionalities.
• We may use aggregated and anonymized data for analytics, performance improvements, and service enhancements.
• We do not sell or rent personally identifiable financial data to third parties without consent.
8. THIRD-PARTY SERVICES & LINKS
• HomePe may integrate with banks, NBFCs, payment gateways, or credit bureaus.
• Use of such third-party services is subject to their respective terms and conditions.
• We are not liable for the accuracy, reliability, or actions of third-party service providers.
9. DISCLAIMER OF WARRANTIES
The Platform and Services are provided “AS IS” and “AS AVAILABLE”.
We do not warrant that:
• The Platform will be uninterrupted, secure, or error-free.
• The results from simulations or recommendations will be accurate or suitable for your financial situation.
• Third-party integrations will always be available or reliable.
You use the Platform at your own risk.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
• HomePe, its directors, officers, employees, or affiliates shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
• Our total liability under any claim shall not exceed the amount you paid (if any) for Services in the preceding 6 months.
11. INDEMNITY
You agree to indemnify and hold harmless HomePe Technologies Private Limited and its affiliates from any claims, losses, or damages arising from your:
• Violation of these Terms,
• Use of the Services,
• Violation of third-party rights.
12. DATA TRANSFER
By using the Platform, you consent to the storage and processing of your information, which may involve cross-border transfers as per applicable data protection laws.
13. AVAILABILITY OF PLATFORM
You agree to indemnify and hold harmless HomePe Technologies Private Limited and its affiliates from any claims, losses, or damages arising from your:
• We strive to ensure availability of the Platform 24/7.
• However, downtime may occur due to maintenance, upgrades, or circumstances beyond our control.
• We are not liable for any loss due to service unavailability.
14. DISCONTINUED SERVICES
We may discontinue or modify any feature or service without liability. If paid services are discontinued, refunds will be issued in accordance with our refund policy.
15. FEES AND PAYMENTS
• Some features may be free, while premium features may require subscription fees.
• You agree to pay all applicable fees at the time of purchase.
• Payments once made are non-refundable, unless otherwise stated.
• We reserve the right to revise pricing with prior notice.
16. NO THIRD-PARTY BENEFICIARIES
This Agreement does not confer rights on any third party.
17. COMPLIANCE WITH LAWS
You are responsible for complying with all applicable Indian laws, including RBI guidelines, data protection laws, and IT Act provisions.
18. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of India.
19. DISPUTE RESOLUTION
All disputes shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Ndu, India.
20. TITLES AND HEADINGS
Headings are for reference only and shall not affect interpretation.
21. SEVERABILITY
If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.
22. TERMS FOR PROMPT/USER-PROVIDED DATA
• Any data or inputs you provide (financial prompts, repayment details, or other submissions) may be used by HomePe to deliver and improve Services.
• You grant us a license to process such inputs without compensation.
• You represent that your inputs comply with laws and do not infringe third-party rights.
